Reviews the final divorce decree for language about the pension plan or retirement account division |

Investigates the benefits, rights and features of the pension plan or retirement account |
|
|
Determines the applicable legal requirements for the division of the pension plan or retirement account |
|
|
Prepares a draft QDRO in accordance with the divorce decree |
|
|
Forwards (in most cases) the draft QDRO to the pension plan administrator for preliminary review |
|
|
Negotiates changes in the draft QDRO with the pension plan administrator |
|
|
Circulates the QDRO for revision, comments, and signature by the spouses and their divorce attorneys (if any) |
|
|
Responds to questions about the QDRO from the spouses and their divorce attorneys (if any) |
|
|
Files the QDRO in the court where the divorce occurred (must be an Oregon, Washington, or Idaho divorce) |
|
|
Obtains a court-certified copy of the QDRO signed by the judge |
|
|
Forwards the court-certified copy of the QDRO to the pension plan administrator for final review |
|
|
Obtains a written determination from the pension plan administrator that the QDRO satisfies applicable legal requirements |
|
|
Reviews the pension plan administrator's written determination for consistency with the terms of the QDRO |
|
|
Notifies the spouses and their divorce attorneys (if any) that the QDRO has been accepted by the pension plan administrator |
